WPAHS Claim Against UPMC and Highmark Stayed by USDC for Western District of Pennsylvania

 Although the Federal Third Circuit Court of Appeals reversed the U.S. District Court’s decision to dismiss WPAHS’s Complaint and remanded the case for further proceedings, the Western District has now stayed any further discovery or any other activity while UPMC and Highmark petition the U.S. Supreme Court for certiorari.

The attached Opinion basically concludes that cert is probable given the conflict between the circuits on the anti-trust issues raised by the case, and that, despite WPAHS’s objections, WPAHS should not be irreparably harmed by waiting several additional months for a U.S. Supreme Court decision.
